This site is operated by Osmo Holdings LLC, trading as Osmo Padel Shop ("we", "us"). By using this site or placing an order you agree to these terms.

1. Who may order

You must be at least 18, or have the consent of a parent or guardian, and give accurate and complete information at checkout. We ship to addresses in the United States only.

2. Products and descriptions

We are an authorised NOX reseller. Product images and specifications come from the manufacturer. We work to keep them accurate, but colours vary between screens, and manufacturers change specifications without notice. A minor difference between the image and the item is not a defect.

3. Prices and availability

All prices are in US dollars and do not include tax, which is calculated at checkout.

We do not discount NOX product. There are no coupon codes, automatic cart discounts, or promotional pricing on this site.

Listing an item is not a guarantee it is in stock. If an item you ordered is unavailable we will contact you with the option to wait, swap, or cancel that line for a full refund.

We may correct an obvious pricing or description error, including after an order is placed. If a price was clearly wrong, we will contact you before charging you, and you may cancel.

4. Orders and acceptance

Your order is an offer to buy. A contract is formed when we send you a shipping confirmation, not when you place the order or receive an order confirmation. We may decline or cancel an order — for example where we suspect fraud, where an address cannot be verified, where quantities suggest resale, or where stock is unavailable. If we cancel after you have paid, you are refunded in full.

5. Payment

Payment is taken at checkout through Shopify Payments. By submitting payment details you confirm you are authorised to use the payment method.

6. Shipping, returns and warranty

Our Shipping Policy and Refund Policy are part of these terms. Manufacturer warranty terms are set by the manufacturer, and warranty determinations are theirs, not ours.

7. Your use of this site

Do not use this site to break the law, interfere with its operation or security, scrape it systematically, or misrepresent who you are. We may suspend access if you do.

8. Intellectual property

The layout, text, and design of this site belong to us. NOX, product names, and product imagery belong to their owners and are used under our authorised reseller relationship. Nothing here grants you a licence to use them.

9. Warranties and liability

Except for the manufacturer warranty described in our Refund Policy and any rights you have under law that cannot be excluded, this site and its content are provided "as is" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.

To the fullest extent the law allows, our total liability for any claim connected to an order is limited to the amount you paid for the item giving rise to the claim, and we are not liable for indirect, incidental, special, or consequential damages, or for lost profits.

Padel and pickleball carry a risk of injury. You are responsible for using equipment appropriately, for your own physical condition, and for following the manufacturer's care and use instructions. Nothing in these terms excludes liability for death or personal injury caused by our negligence, or for fraud, where that exclusion is not permitted.

10. Indemnity

You agree to indemnify us against claims arising from your breach of these terms or your misuse of the site.

11. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida, and you and we consent to that jurisdiction.

12. Changes

We may update these terms. The version in force is the one published here when you place your order. Continued use of the site after a change means you accept it.

13. Severability and entire agreement

If any provision is held unenforceable, the rest stays in force. These terms, together with the policies referenced above, are the entire agreement between you and us about this site.
